TERMS OF USE, COMMUNITY RULES AND PRIVACY POLICY — DELARIA Last updated: 28 giugno 2026 This document governs access to and use of the Delaria platform («Service»), operated by the Controller listed in § B.1. Please read it carefully before using the app. ══════════════════════════════════════ PART A — TERMS OF USE ══════════════════════════════════════ A.1 Acceptance By accessing, registering, or using the Service you confirm you are at least 16 years old (or, where permitted by applicable law, at least 14 with parental consent) and accept these Terms in full. If you do not agree, do not use Delaria. A.2 Nature of the Service — General disclaimer Delaria provides reading, poetic composition, text exploration, personal diary, sound meditations, and AI-assisted features for cultural, creative, and general wellness purposes. The Service does NOT replace: • medical, psychological, psychiatric, or therapeutic advice; • legal, tax, or professional counsel; • emergency services. In an emergency, contact local emergency services. Do not use Delaria for diagnosis or treatment. Content (including AI-generated or suggested text) may be incomplete, inaccurate, or unsuitable for your situation. You use it at your sole risk. A.3 Account and identity You may use the Service as a guest or registered user. Profile data powers your personal archive. Other users' full identity is not viewable in the app. You are responsible for credential confidentiality and all activity on your account. A.4 Code of conduct — Lawful and respectful use You agree to use Delaria lawfully and respectfully. You must not post, share, or generate content that: a) promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation or identity, age, disability, socioeconomic status, or other protected characteristics; b) includes insults, threats, harassment, stalking, doxing, or bullying; c) carries political propaganda, electoral content, partisan campaigning, or polarizing political debate unrelated to the Service's poetic and cultural purpose; d) promotes supremacist ideologies, genocide denial, hate symbols, or crime apology; e) is pornographic, sexually explicit in inappropriate context, or exploits minors; f) infringes copyright, trademarks, trade secrets, or others' privacy; g) contains spam, fraud, malware, or impersonation; h) violates applicable law in Italy, the EU, or your country of residence. We may remove content, restrict features, or suspend/terminate accounts, with or without notice, for serious or repeated violations. A.5 User content — Intellectual property and license Unless otherwise stated for public-domain corpus texts or third-party licenses shown in the app: • You retain copyright and other IP rights in your original works. • You represent and warrant you have all rights needed to upload, publish, or share content and that it does not infringe third-party rights. • By submitting content (private fragments, public voices, metadata), you grant the Controller a non-exclusive, worldwide, royalty-free, sublicensable, transferable license limited to operating the Service: hosting, backup, technical processing, moderation, in-app display, Service improvement, and legal compliance. For public voices, this includes display to other registered users within the Service. • To the extent permitted by law, you waive contractual or extra-contractual claims against the Controller arising from the license above, subject to § A.11 indemnity and non-waivable moral rights. • You acquire no rights in others' content or Delaria software. Copyright reports: privacy@delaria.app (subject: «Copyright report») with proof of rights and content URL/ID. A.6 AI-generated content AI features (refinement, meditations, translation, TTS, etc.) are provided «as is». We do not guarantee accuracy, originality, or legal suitability. You are responsible for reviewing content and, if publishing, complying with these Terms. AI output is not professional advice. A.7 Diary, archives, and preference signals Saved passages, journeys, fragments, and voices are stored in your cloud account. You may delete them from Profile. Anonymous preference signals (Profile opt-in) are aggregated for internal statistics and do not expose personally identifiable data in the public feed. A.8 Premium and payments Subscriptions or in-app purchases are also subject to the payment provider's terms (e.g. Stripe). Pricing, renewal, and withdrawal rights are shown on the Premium page and at checkout. EU consumer withdrawal rules apply to digital content as required by law. A.9 Disclaimer of warranties TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED «AS IS» AND «AS AVAILABLE» WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ERROR-FREE OPERATION. A.10 Limitation of liability TO THE EXTENT PERMITTED BY LAW, THE CONTROLLER, ITS REPRESENTATIVES, EMPLOYEES, PARTNERS, AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM USE OR INABILITY TO USE THE SERVICE. TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID TO THE CONTROLLER IN THE 12 MONTHS BEFORE THE EVENT (OR, IF LOWER, EUR 50), EXCEPT WHERE FRAUD OR GROSS NEGLIGENCE CANNOT BE EXCLUDED. A.11 Indemnity You indemnify and hold harmless the Controller from claims, damages, costs, and expenses (including reasonable legal fees) arising from: (i) your submitted content; (ii) breach of these Terms or law; (iii) infringement of third-party rights. A.12 Third-party services The Service may integrate Firebase/Google Cloud, AI providers, Stripe, and others, subject to their terms and privacy policies. A.13 Changes, suspension, termination We may modify the Service or Terms. Material changes will be communicated reasonably (e.g. in-app). You may stop using the Service at any time. We may suspend or terminate the Service or accounts for legal, security, or contractual reasons. A.14 Governing law and jurisdiction Except mandatory consumer protection rules in your country of residence, these Terms are governed by Italian law.
